From the bill of $900 the sum of $540 was taxed off, bringing it to the more respectable dimensions of $360. I can imagine what a sad disappointment there was ; but, all the same, it would seem as if, in the cases in which this taxing arrangement is not carried out, the department would be paying almost too much for the services of Mr. McAlpine. He seems to have a high estimate of the value of his services as compared with the Justice Department.

Why was any amount paid to Mr. McAlpine at all in connection with the purchase of the Canada Eastern Railway ? I thought the rule was that the expenses of verifying the titles are paid by the seller.

That cannot be the rule either in this or any other country. Suppose that we had purchased the Canada Eastern without having the title thoroughly inquired into, suppose that the department depended upon the word of the vendor, and afterwards it turned out that this whole railway was encumbered, do yon think the department would not be held responsible for not having had its own legal adviser go through the title.

There is no difference with us on that point, but I say that the seller furnishes an abstract of the title and the purchaser sees if that abstract is correct, but as a general rule the seller pays for the search.

I explained, when my hon. friend was absent, that we had run against quite a barrier in this matter. A question arose regarding interference with a mill property, and the owners, Messrs. Tett Bros., asked what seems to me a very exorbitant sum, and certainly until I can be satisfied that the property can be secured at a reasonable price, I would not be inclined to move further in the matter.

I said I would explain the position in which the matter was. The negotiations are not quite complete. The officers of my department met the officers of the Crown Lands Department of Ontario at Toronto and arranged on a certain basis on which we would take over these works which had been constructed by the province and free the province from any future expenditure on their maintenance. The waterworks we would have charge of. and we would have a dam built. That has been made the subject matter of a report to Council, which is submitted to the provincial government at Toronto, and we hope to have the matter carried out because the negotiations were practically concluded but were not put in the shape of an Order in Council on behalf of either government.
